This policy explains how to cancel a project, consulting engagement or support plan with A & P Software Tech, what you’ll be charged, and how refunds work. It forms part of our Terms of Service. If your written proposal sets out different cancellation terms for your project, the proposal applies.
How to cancel
You can cancel at any time. To make sure there’s a clear record, please cancel in one of these ways:
- By email: write to angelika@apsoftwaretech.com with the name of the project and the date you’d like work to stop.
- By phone: call +1 (425) 560-3363. We’ll then confirm the cancellation by email, and that confirmation becomes the written record.
The cancellation takes effect on the date you ask for or, if you don’t give one, on the day we receive your email or call. We’ll stop work from that date, confirm the cancellation in writing and send you a final statement.
What you pay
When you cancel a development project or consulting engagement, you pay for:
- Work completed up to the date the cancellation takes effect. This is based on your proposal: completed milestones, plus a fair share of any milestone in progress that reflects the work actually done. Your final statement shows how we’ve calculated it.
- Non-refundable third-party costs already incurred on your behalf with your approval, such as software licenses, domain registrations or paid services that can’t be canceled or transferred to you.
There’s no separate cancellation fee.
Refunds
- If you’ve paid more than the amount due, we’ll refund the difference within 14 days of the cancellation taking effect.
- Refunds are made in the currency you paid in and, where possible, using the same payment method.
- If the amount due is more than you’ve paid, the balance is payable within 14 days of our final statement.
What you keep
- Completed work. We hand over everything we’ve completed for you, including source code, designs and documentation, and ownership transfers to you once it’s paid for.
- Discovery deliverables. Once you’ve paid for a discovery phase, the written scope, prototypes and other discovery deliverables are yours to keep and use however you like, including with another supplier, whether or not the project goes ahead. If you cancel partway through discovery, you receive the work completed up to that point.
- Your materials and accounts. We return or delete your materials, as you prefer, and make sure you have full control of every account, code repository and credential connected to your project.
Consulting engagements and sessions
- Before work starts. If you cancel a consulting engagement before any work has begun, we refund anything you’ve paid in full.
- Partway through. If you cancel during an engagement, you pay for the work completed to date, and we deliver the findings and materials prepared up to that point.
- Rescheduling a session. You can move a scheduled session at no cost by giving at least 48 hours’ notice before its start time. With shorter notice we’ll still try to find another time, but late changes and missed sessions may count as delivered.
- If we need to reschedule. We’ll give you as much notice as possible, offer alternative times and never charge you for a session we move.
Support plans and subscriptions
- You can cancel an ongoing support plan by giving 30 days’ written notice, unless your plan agreement sets a different notice period.
- Support continues as normal during the notice period. Fees for that period are payable, and anything you’ve prepaid for time after it ends is refunded within 14 days of the end of the notice period.
- When the plan ends, we’ll hand over the access, credentials and documentation you need and help move support to your own team or another provider.
- Where we manage third-party subscriptions for you, such as hosting or domain renewals, we’ll transfer them to you or cancel them, as you prefer. Charges already made by those providers are subject to their own refund terms.
If we cancel
If we ever need to end an engagement for our own reasons (rather than because of unpaid invoices or a breach of our terms), we’ll give you at least 30 days’ written notice, hand over all completed work, and refund anything you’ve paid for work we haven’t done.
Your legal rights
If you’re an individual buying services for personal use, consumer protection laws where you live may give you additional rights, such as a right to cancel within a set period after agreeing to a contract. This policy doesn’t affect those rights.
