This policy explains how A & P Software Tech collects, uses and protects personal information when you visit our website at https://www.apsoftwaretech.com, contact us or work with us. In this policy, “we”, “us” and “our” mean A & P Software Tech.
We work with clients around the world, so this policy is designed to reflect the principles of the EU General Data Protection Regulation (GDPR) and the UK GDPR, as well as US state privacy laws such as California’s. Where the law in your location gives you additional rights, we respect them.
Who is responsible for your information
A & P Software Tech is responsible for the personal information described in this policy. Under data protection law, that makes us the “controller” of that information.
For any privacy question or request, email angelika@apsoftwaretech.com.
Information we collect
When you contact us. If you send an inquiry through the form on our website, by email or by phone, we collect:
- your name and email address;
- your phone number, if you give it;
- the name of your company or organization;
- details about your project, such as what you need, your timeline and your budget range; and
- anything else you choose to include in your message.
When you work with us. We keep records of our work together, such as contact details for the people involved, correspondence, meeting notes, proposals, contracts, invoices and payment records. If we record a video call (for example, a walkthrough or training session), we’ll tell you before recording starts.
When you visit our website. Our hosting provider may automatically record basic technical information in server logs, such as your IP address, browser type, the pages requested and the date and time of each request. This is used only to keep the site secure and working properly. We don’t use analytics or advertising trackers. See our Cookie Policy for the single item the site stores in your browser.
From other people. If a colleague introduces you or adds you to a project, we may receive your name and work contact details from them. We may also look at publicly available information about your organization, such as its website, to prepare for a conversation.
Please don’t include sensitive information, such as health details, financial account numbers or government ID numbers, in an inquiry. We don’t need it to respond.
How we use your information
We use personal information only for the purposes below. For people in the UK, the European Economic Area and other places with similar laws, we also list the legal basis we rely on.
- Responding to your inquiry and preparing a proposal. Legal basis: taking steps you’ve asked for before entering into a contract, and our legitimate interest in replying to people who contact us.
- Delivering our services and managing our relationship with you. Legal basis: performing our contract with you or your organization.
- Invoicing, accounting and meeting tax and other legal requirements. Legal basis: complying with our legal obligations.
- Keeping our website and systems secure. Legal basis: our legitimate interest in protecting our business and the people who use our site.
- Sending occasional updates about our services. We do this only if you’ve asked for them or, where the law allows, if you’re an existing client, and every message includes a simple way to opt out. Legal basis: your consent or our legitimate interests.
- Establishing, exercising or defending legal claims. Legal basis: our legitimate interest in protecting our rights.
Where we rely on consent, you can withdraw it at any time. Where we rely on legitimate interests, we’ve balanced them against your rights, and you can object at any time. We don’t use your information for automated decision-making that has legal or similarly significant effects on you.
Information we handle for our clients
When we build or support software for a client, we may have access to personal information held in their systems, such as records about their customers or employees. For that information, our client is the controller and we act as their processor: we use it only to provide the services, follow their instructions, keep it secure and sign a data processing agreement where required. The client’s own privacy notice, not this one, explains how that information is handled.
How long we keep information
- Inquiries that don’t lead to a project: up to 24 months after our last contact, so we have context if you get in touch again. You can ask us to delete them sooner.
- Client and project records: for as long as we work together, then for as long as needed for legal, tax and accounting purposes, typically up to seven years.
- Server logs: for a short period, in line with our hosting provider’s standard settings.
When we no longer need information, we delete it or make it anonymous.
Who we share information with
We share personal information only when it’s necessary to run our business:
- Service providers that process information on our behalf, including website hosting, email and office software, the form service that delivers website inquiries to us, video conferencing, project management tools, and accounting and invoicing software. They may use the information only to provide their services to us, and they must keep it secure.
- Professional advisors, such as accountants, lawyers and insurers, where needed.
- Authorities and other parties when the law requires it, or when it’s necessary to protect our rights, property or safety, or those of others.
- A new owner of our business, if all or part of it is ever sold or restructured, in which case your information would remain protected by this policy.
You can ask us for a current list of the service providers that handle your information.
We don’t sell your information
We don’t sell personal information, and we don’t share it for cross-context behavioral advertising, as those terms are used in California law. We don’t use advertising trackers, social media pixels or third-party analytics on our website.
International transfers
Because we work remotely with clients worldwide and use online service providers, your information may be processed in countries other than the one where you live, and those countries may have different data protection laws. When we transfer personal information out of the UK, the European Economic Area or another region with transfer rules, we use recognized safeguards, such as transfers to countries with an adequacy decision, the European Commission’s Standard Contractual Clauses or the UK International Data Transfer Addendum. Contact us if you’d like more information about these safeguards.
How we protect information
We use reasonable technical and organizational measures to protect personal information, such as encrypted connections, access limited to the people who need it, and multi-factor authentication on the accounts that hold client information. No system is completely secure, but if a breach affects your information, we’ll notify you and the relevant authorities where the law requires.
Your rights
Depending on where you live, you may have the right to:
- access the personal information we hold about you and receive a copy;
- correct information that is inaccurate or incomplete;
- delete your information;
- restrict or object to how we use it, including for direct marketing;
- receive your information in a portable format, or have it sent to another organization;
- withdraw your consent where we rely on it;
- opt out of the sale or sharing of your personal information (we don’t sell or share it, but you can still ask); and
- be treated equally, without discrimination, for exercising any of these rights.
We aim to honor reasonable requests from anyone, wherever they live.
How to exercise your rights
- Email angelika@apsoftwaretech.com and tell us what you’d like us to do. You can also call +1 (425) 560-3363, and we’ll confirm your request in writing.
- We may need to verify your identity before acting on a request, and we’ll ask only for the information needed to do so.
- Where the law allows, you can ask an authorized agent to make a request for you. We may ask for proof that they’re acting on your behalf.
- We’ll respond within the time the law requires, normally within one month, or 45 days where US state law applies. There’s no charge for making a request.
- If we can’t fully meet your request, we’ll explain why, and you can ask us to reconsider.
If you’re unhappy with how we’ve handled your information, please contact us first so we can try to put it right. You also have the right to complain to a data protection authority, such as the Information Commissioner’s Office in the UK or the supervisory authority in your EU country.
